San Miguel County– On Saturday, April 06, 2013 at 2:19 a.m., Las Vegas State Police officers responded to a single vehicle roll over on I25, mile post 337, near Tecolote NM.
Once on scene, officers observed a silver Infiniti sedan that was flipped on its roof in the median. Officers also noticed all eight of the occupants were ejected from the vehicle. Officers began to immediately medically assess all subjects.
Two juveniles were confirmed deceased. They were identified as Kayla Martinez (14) of Las Vegas NM and Aleandra Sanchez (12) of Villanueva NM. Rubio Reyes (21) of Las Vegas NM was transported to a Santa Fe hospital and is listed in critical condition. Briana Sanchez (13) of Las Vegas NM was transported to an Albuquerque hospital where she is in serious but stable condition. Kayla Esquibel (17); Alexandria DeLao (22); Joseph Martinez (21) all of Las Vegas NM were transported to the Las Vegas Hospital for non life threatening injuries.
The driver of the vehicle was identified as Wayne Lovato (17) of Las Vegas NM. Lovato is currently checked into the Las Vegas Hospital for serious injuries.
Based on the investigation by officers, it was concluded Lovato was driving the vehicle while under the influence of an intoxicating liquor. Upon the initial arrival of officers, Lovato was not on scene. He was later located at the Las Vegas hospital. Lovato was transported by a relative. Once Lovato is released from the hospital, he will be remanded to the custody of the juvenile detention center.
Alcohol, speed, and reckless driving are all contributing factors to this crash.
Lovato is charged with:
- Two counts of homicide by vehicle ( 3rd degree felony)
- Two counts of great bodily harm my vehicle (3rd degree felony)
- Aggravated, refusal, driving while under the influence of intoxicating liquor or drugs (1st a misdemeanor)
- Reckless driving (a misdemeanor)
- Failure to render aid (a misdemeanor)
